Detroit didn’t violate the constitutional rights of a medical marijuana dispensary when it denied an application to open a storefront in a drug-free zone, a federal appeals court ruled.
Green Genie Inc. failed to show it was deprived of a property interest without due process, the US Court of Appeals for the Sixth Circuit ruled Tuesday, in an opinion by Chad A. Readler.
A government benefit, such as a permit, is not a protected entitlement if officials “may grant or deny it in their discretion,” Readler said, citing a 2005 US Supreme Court ruling.
