Costa Sunglasses $40 Million Settlement Gets Court’s Approval

Costa Del Mar Inc. and consumers alleging it overcharged for warranties and repairs to sunglasses won final approval from a federal court in Florida of a $40 million settlement providing vouchers.

But Costa and the plaintiffs must address how to give back to class members $4 million from reduced attorneys’ fees, the U.S. District Court for the Middle District of Florida said.

The settlement resolved three lawsuits alleging Costa unlawfully charged consumers for warranties and repairs despite promises of a “lifetime warranty” and “nominal” repair fee. The court certified nationwide and Florida settlement classes of customers who paid warranty or ...
