Target Loses Bid for Quick Appeal of Workers’ Group Status Win

Target Corp. will have to face a group of workers who say it misclassified them as exempt from overtime after a federal district judge rejected the company’s request to have an appellate court weigh in.

The conditional Fair Labor Standards Act collective certification order doesn’t involve a controlling question of law, there isn’t substantial ground for difference of opinion, and certifying the order for interlocutory appeal wouldn’t materially advance the wage-and-hour litigation, the US District Court for the District of Minnesota said Thursday.
