Driveshaft Patent Case That Divided Fed. Cir. Appealed to SCOTUS

A case about a solution for noisy driveshafts that a Federal Circuit judge said has “bitterly split” that court over patent eligibility has been appealed to the U.S. Supreme Court.

The U.S. Court of Appeals for the Federal Circuit rejected American Axle & Manufacturing Inc.'s request for a full court rehearing on the validity of its noise-reducing driveshaft patent in July, in a six-to-six tie that included five separate concurring and dissenting opinions. The court previously held the invention was patent ineligible because it was directed to a natural law.
