EEOC Goes to Trial as Defendant in Black Woman’s Pay Bias Suit

The Equal Employment Opportunity Commission must face trial for allegedly paying a Black woman less to lead the IT support services in its Chicago district office than it paid a White man who previously performed that work.

Alison Hardiman at least has evidence that would permit a jury to find that the federal agency tasked with regulating employer fairness discriminated against her, the US District Court for the District of Illinois said.

The ruling Wednesday illustrates that employer’s risk losing summary judgment motions in equal pay lawsuits by failing to present a justification for a pay disparity.
