Florida A&M University Underfunding Suit Revived on Appeal (1)

Florida officials must defend against a lawsuit claiming the state underfunded a historically black college by nearly $2 billion over the last three decades, a split federal appeals court ruled Tuesday.

Claims that vestiges of racial segregation led to less state cash assistance for Florida A&M University were dismissed at the trial court level. The US Court of Appeals for the Eleventh Circuit found the lower court was too skeptical of the plaintiffs—a group of students looking to form a class—who can now get a chance to back up their discrimination claims with data, the court ruled.
