Canada’s tax authority won an appeal over its conduct during an investigation and prosecution of what the agency alleged were fraudulent applications for scientific research tax credits.
The Federal Court of Appeal dismissed an appeal Tuesday by accountants Allan Jay Gordon and James Allan Deacur who sought to overturn a 2019 decision by Tax Court of Canada Justice Robert L. Barnes.
Gordon and Deacur claimed Barnes ignored evidence and misunderstood the law when he ruled the Canada Revenue Agency’s pursuit of criminal charges against them was lawful.
