Tax Justice Group Challenges 10 Kenyan Treaties in Court

A tax advocacy group is asking a Kenyan court to overturn 10 double tax treaties for being unconstitutional, and is pressing for more transparent treaty ratification processes in the future.

Tax Justice Network Africa filed a constitutional petition Sept. 24 in Kenya’s High Court, challenging the government’s double tax agreements with Iran, Kuwait, Seychelles, South Africa, Qatar, Korea, the United Arab Emirates, India, the Netherlands, and Mauritius.

Countries sign the treaties to help avoid applying double taxation to companies and individuals, and provide dispute resolution mechanisms if there are squabbles over taxing rights.
