European Union law on energy taxation doesn’t oblige payment of interest on tax refunds, but the right to equal treatment enshrined in EU law might, an adviser to the bloc’s top court said Wednesday.
National courts should decide whether the right of equal treatment, which is included in the EU Charter of Fundamental Rights, should be used to justify interest payments on energy tax refunds, EU Court of Justice advocate general Maciej Szpunar said in an opinion on a case referred from Germany.
