Airbnb Host Loses Challenge to Santa Monica Vacation Rental Rule

An Airbnb host failed to show Santa Monica’s short-term vacation rental ordinance violates the dormant commerce clause, the Ninth Circuit ruled in affirming dismissal of a proposed class action.

Arlene Rosenblatt filed the lawsuit in response to Santa Monica’s ordinance, which bans property rentals of 30 days or fewer when there isn’t a primary resident there. She had rented out her house on Airbnb before the measure was enacted, according to court records.
