Arizona Supreme Court to Hear Challenge to Income Tax Increase

The Arizona Supreme Court will hear a challenge to a voter-approved income tax increase on high earners to fund education.

An order filed Thursday sets oral arguments for April 20 in a case brought by Republican lawmakers and others arguing that the tax, approved in November as Prop. 208, violates the state constitution.

  • The plaintiffs, represented by free-market think tank the Goldwater Institute, appealed a February trial court ruling against them.
  • The case is Fann v. Ariz., Ariz., No. T-21-0003-CV, 3/4/21.
