California Court of Appeal Affirms Judgment on Improper Fire Protection Property Tax Implementation, Grants Refund

The California Court of Appeal Nov. 6 affirmed the Mendocino County Superior Court decision granting Taxpayer a special fire protection property tax refund. Taxpayer, a commercial timberland operator, was assessed a special fire protection tax, approved by taxpayers called Measure M. Taxpayer paid the assessment under protest, and timely filed a complaint for refund of the tax payments. The superior court determined Taxpayer’s parcels weren’t part of the Albion-Little River Fire Protection District, and Taxpayer was entitled to a refund. The district appealed.
