Exelon Owes Property Tax on Nuclear Fuel Casks, NJ Court Says

Exelon Generation Co. failed to convince the New Jersey Tax Court on Tuesday that 200,000-pound casks used to store highly radioactive spent fuel from a nuclear power plant are movable property not subject to tax.

The site of the now-defunct Oyster Creek Nuclear Generating Station contains 67 concrete- and metal-lined casks intended to keep the spent fuel from exposing the public and the environment to harmful radiation. Former owner Exelon and the current owner, a Holtec International Corp. subsidiary, dispute the Township of Lacey’s assessment of property taxes on the casks for 2018-2024.
