Fight Over City Fee Requirements Hits California High Court

California Supreme Court justices questioned Tuesday how far local governments can go to charge franchise fees without triggering voter approval requirements, and when such fees violate the law.

The case is the latest in the long-running battle over how many votes are needed to pass tax measures in California. But this one involves a city contract that requires a portion of the franchise fee be returned to the city, which opponents argue is intended to get around tax and fee limitations under voter-approved initiatives.
