Indiana DOR Determines Taxpayer Didn’t Provide Documentation to Prove Employees Paid Withholding Tax, Denies Protest (Decision 1 of 4)

The Indiana Department of Revenue (DOR) Nov. 27 issued a letter ruling denying Taxpayer’s protest of a withholding tax assessment, determining that Taxpayer failed to establish that the withholding tax at issue was paid by its employees on their individual income tax returns. Taxpayer was a service provider and as an employer, it filed state and county income tax withholding returns for corporate income tax purposes. The DOR ascertained that Taxpayer didn’t accurately withhold the tax for all employees and issued proposed assessments.
