Lowe’s Loses Another Tax Appeal Using ‘Dark Store’ Theory

For the second time in a month a Wisconsin appeals court has tossed Lowe’s Home Centers LLC’s bid for a property tax reduction under the “dark store theory” of property valuation.

The Wisconsin Court of Appeals in a decision Wednesday supported an earlier circuit court ruling that rejected a property tax appeal by Lowe’s for a store in Delavan, Wis., for the tax years 2016 and 2017.
