Marijuana Dispensary Demands New Hearing in IRS Dispute

A Colorado marijuana dispensary has asked for a rehearing from the Tenth Circuit over a dispute with the IRS involving improper business deductions.

Standing Akimbo LLC filed a petition for rehearing en banc Friday, arguing that the court misapplied the motion for summary judgment and worked from incorrect facts to make its ruling. The petition said there is “no compelling reason to place the burden of proof on the taxpayer to show that summoned documents do not exist.”
