No Tax Credit for Missouri Couple’s Car Owned by Their Trust

A couple isn’t entitled to a sales tax credit for a new car because the vehicle is owned by a revocable trust, the Missouri high court has ruled.

The Supreme Court of Missouri’s opinion, issued April 6, affirms an earlier decision by the Administrative Hearing Commission to deny the credit to David and Gale Collison.

The commission had noted that natural persons and trusts are separate entities under Missouri law. It found that the Collisons owned a previous vehicle, a Chevy, and that the revocable trust owned the new car, a Toyota, that replaced it. The...
