North Carolina Governor Signs Law on Property Tax Provision Concerning In Rem Method of Foreclosure

The North Carolina Governor Nov. 6 signed a law concerning the in rem method of foreclosure for property tax purposes. The law includes measures: 1) creating a $300 fee for in rem foreclosures if the property is sold under execution; 2) clarifying that the fees for docketing and indexing the certificate assessed pursuant to G.S. 7A-308(a)(11) shall be payable to the clerk of superior court at the time the taxes are collected or the property is sold; and 3) providing that the fee assessed in G.S. 7A-308(a)(1a) shall be payable to the clerk of superior court out of the sale...
