Virginia Tax Commissioner Determines Individual Income Taxpayer Entitled to Credit for Out-of-State Tax Payment

The Virginia Tax Commissioner March 8 determined in a letter ruling that Taxpayer was entitled to an individual income tax credit for payment of tax to another state. Taxpayer resided in Virginia while working in another state for the U.S. Department of State. Taxpayer filed a resident return in her state of domicile and a Virginia part-year resident return, claiming credit for the tax paid to her state of domicile. The Department of Taxation adjusted the return to reflect Taxpayer as a full-year Virginia resident. Taxpayer paid the assessment and appealed.
