Alabama High Court Denies Attempt to Recoup State Liquor Taxes

The Alabama Supreme Court affirmed a lower court’s dismissal of a class action seeking return of allegedly unauthorized alcohol sales taxes.

The court on Friday ruled in favor of the Alabama Alcoholic Beverage Control Board in its dispute with Cary Reagan Jr., who had asserted that a 2% tax and a 4% tax on retail sales were calculated improperly. The plaintiff had asked the court to direct the ABC board to repay the taxes in question to a fund for taxpayers who had allegedly overpaid, grant injunctive relief for his court fees, and establish a procedure for taxpayers to appeal ...
