Court Asked to Rehear Denial of Tax Break for Property Donation

A three-judge panel’s ruling invalidating a $15 million tax deduction for donating the rights to develop property should be reheard because it conflicts with other decisions, according to a petition to the Sixth Circuit.

In the court filing, Hoffman Properties II LP asked the U.S. Court of Appeals for the Sixth Circuit to review its panel’s decision denying the tax deduction for donating a conservation easement—where property owners donate the right to develop their property in the future, potentially allowing for a deduction.
