An appeals court judicial panel has declined to provide broader instructions to a trial court on what to consider in a lawsuit challenging the constitutionality of an IRS seizure of cryptocurrency records.
In an Oct. 3 panel rehearing request, the IRS asked a three-judge panel of the US Court of Appeals for the First Circuit to allow a trial court to consider additional reasons for dismissing the lawsuit, after the panel rejected the trial court’s initial reason and sent the case back with specific instructions on what to address next.
