Koch-Backed Group Argues California Donor Law Unconstitutional

A nonprofit backed by industrialist Charles Koch argued that a California law requiring nonprofits to disclose information on their donors is unconstitutional and is barred by the First Amendment, in a filing to the Supreme Court.

Americans for Prosperity Foundation stated in a brief that California’s donor requirement rule is prohibited by the First Amendment and must be “narrowly tailored” to an overriding government interest. The state’s demand for the organization to provide its IRS Form 990 Schedule B is unconstitutional, the nonprofit said to the high court.
