New York Should Win in Tax Fight With Tobacco Company: Court (1)

A district court needs to give the state of New York a win in its fight with a Washington-based tobacco company, the Second Circuit said.

The U.S. Court of Appeals for the Second Circuit agreed with the state’s cross appeal, which challenged a lower court’s dismissal on summary judgment of its claim involving a federal cigarette-trafficking statute, according to the Nov. 7 decision.
