No Court Rehearing on Rejection of Property Donation Tax Break

The Sixth Circuit won’t reconsider a panel ruling that rejected a $15 million tax deduction for creating protections for the facade and airspace of a historic Ohio building.

Hoffman Properties II LP asked for a rehearing of a ruling by three judges finding that Hoffman wasn’t entitled to a charitable tax deduction for donating a conservation easement—where Hoffman gave away rights to develop its property in the future. The U.S. Court of Appeals for the Sixth Circuit rejected that request on Wednesday, setting up a potential appeal to the U.S. Supreme Court.
