Ohio Reignites Challenge to Pandemic Aid Spending Restrictions

Ohio has gone back to federal court to fight against a congressional ban on state tax cuts that tap into $350 billion in federal pandemic aid.

The state, the first among more than a dozen Republican-led states to sue over the restriction, on Wednesday asked the U.S. District Court for the Southern District of Ohio for a permanent injunction and declaratory judgment, after a federal judge last week denied its request for a preliminary injunction. It argues in its latest submission that the court “should declare the Mandate unconstitutional and permanently enjoin its enforcement.”
