South Dakota Voters Approve Constitutional Amendment Legalizing Marijuana, Imposing 15 Percent Excise Tax on Marijuana Sales

The South Dakota Voters Nov. 3 approved a constitutional amendment legalizing marijuana. The amendment includes measures: 1) defining relevant terms; 2) authorizing the Department of Revenue to issue marijuana-related licenses; 3) allowing local governments to regulate or ban the establishment of licensees within their jurisdictions; 4) explaining that hemp isn’t legalized, but the legislature may pass laws regulating the cultivation, processing, and sale of hemp; and 5) imposing a 15 percent tax on marijuana sales. Upon verification of the passage of the amendment, the measure takes effect July 1, 2021. [S.D. Amendment A, approved by ballot 11/03/20]
