Subregulatory Guidance From Treasury to Slow This Year

The Treasury Department doesn’t plan to issue much subregulatory guidance—such as revenue procedures and notices—this year, a top official said.

“We expect subregulatory guidance to substantially diminish this year,” said David Kautter, Treasury’s assistant secretary for tax policy. “We should have a limit on notices announcing intent to issue proposed regulations.”

Kautter—speaking April 1 at a Tax Executives Institute conference in Washington—referenced a recent announcement from Treasury to that effect, which he characterized as “sort of a declaration that we believe in notice and comment” as an important part of the regulatory process.
