University of California Retirees Lose Bid for Pension Boost

University of California retirees who sought higher pensions under a 1999 resolution aimed at mitigating the effects of federal tax code limitations lost their class action when a state appeals court ruled they lacked an enforceable right to these benefits.

The 1999 resolution adopted by the regents of the University of California didn’t create a contractual right to benefits, because it merely contemplated the creation of additional benefits if future conditions were satisfied, the California Court of Appeal, First Appellate District ruled Monday.
