An income tax increase on high earners passed by Arizona voters on Election Day violates the state’s requirements for taxing and spending, the Goldwater Institute alleged in a lawsuit Monday.
The complaint from the public policy think tank asked the Maricopa County Superior Court to void Prop. 208, which will add a 3.5% income tax surcharge on taxable income over $250,000 for individuals and $500,000 for married couples to fund education. Nearly 52% of voters approved the measure, according to election results certified Monday.
