The Ohio Supreme Court will determine if the state’s privilege for physician peer review materials applies to resident physicians’ files.
The court said Tuesday that it will review the privilege’s application in a medical malpractice case brought by Kalvyn Stull, who received treatment at Summa Health System in Akron for injuries he received in a car accident.
Stull—through his wife and guardian Cynthia Stull—alleged his injuries were exacerbated by care provided by Mazen Elashi.
