A federal district court in Louisiana denied a pharmacist partial summary judgment in her ERISA action against New York Life Insurance Company, Paul Revere Life Insurance Company, and Unum Group, for conspiring to deny her disability benefits for her multiple sclerosis. The court said the pharmacist failed to satisfy multiple conditions required to obtain benefits under the policy, and provided materially false information regarding her actual employment and income. And the court ordered the pharmacist to show cause why summary judgment shouldn’t be entered in the insurance companies’ favor.
