A federal district court in Pennsylvania denied Carpenters Pension and Annuity Fund of Philadelphia’s motion to dismiss a Riff Group LLC employee’s ERISA action contending that it arbitrarily and capriciously denied his waiver of suspension of benefits application, which would allow him to retire with a full pension while continuing to work in his current employment. According to the court, the employee adequately pleaded the existence of an ERISA plan, that he was a beneficiary under the plan, and that the fund’s denial of benefits was unreasonable and based on pretextual reasons.
