Ex-Amazon Worker Gets Partial Green Light for COBRA Notice Suit

A former Amazon.com Services LLC worker advanced her proposed class action claiming the company’s COBRA notices include an “ominous warning” that dissuades workers from exercising their right to stay on the company’s health plan after leaving their jobs.

Judge Jose E. Martinez on Wednesday allowed plaintiff Teresa Lites to move forward with claims that Amazon’s COBRA notices weren’t “written in a manner calculated to be understood by the average plan participant,” because they included an unnecessary and potentially inaccurate warning about criminal and civil penalties.
