Nevada’s federal district court will allow a wage fixing lawsuit filed by a Peruvian sheepherder to move forward after an industry group sought to toss the case.
The lawsuit filed last year by Ucharima Alvarado argued that employers represented by the Western Range Association colluded to suppress wages of both domestic and foreign sheepherders near a floor allowed by the US Department of Labor.
The H-2A program, which has no annual limit on visas issued, allows employers to bring in foreign workers for temporary and seasonal agricultural jobs.
