Meta Defeats Copyright Claims on Facebook Thumbnail Photographs

Meta Platforms Inc. won dismissal of most claims in a lawsuit alleging that “check-in” and “pre-fetching” tools on the Facebook website enabled the misappropriation of copyrighted content.

Plaintiff Don Logan alleged in a class action complaint that the tools allowed Facebook to download his photographs onto Facebook servers and storage sites owned by third parties, facilitating their further misappropriation by other Facebook users.

The company incurred direct and secondary liability for copyright infringement as a result, and violated the Logan Act and the Digital Millennium Copyright Act, the complaint said.
