The US Labor Department is raising its civil penalty amounts for federal labor violations effective Jan. 15 under a final rule scheduled to be published Jan. 10.
The maximum civil penalty for employers that violate the federal Fair Labor Standards Act’s tip provisions will be $1,409, up from $1,373, according to the rule. The FLSA applies the penalty to employers that unlawfully keep employees’ tips.
The maximum penalty for FLSA minimum wage and overtime violations will be $2,515, up from $2,451, according to the rule.
