ANALYSIS: Section 230 Challenged by Contract, Product Claims

The liability shield section of the Communications Decency Act of 1996, often referred to simply as Section 230, is constantly criticized by lawmakers on both sides of the aisle, but for different reasons. As a result of partisan division, there has not been a single floor vote on any of the numerous legislative proposals to amend Section 230 introduced in the last few years. The lack of legislative consensus aside, some recent appellate court decisions have shown that this tech liability shield is not always a successful defense to claims involving online content.
