Blackbaud Loses Bid to Toss Negligence Claims Over Data Breach

Blackbaud Inc. lost its bid to dismiss general and gross negligence claims in consolidated would-be class action litigation over a 2020 ransomware attack, after a federal court in South Carolina said the plaintiffs sufficiently alleged that the data management company owed a duty of care to its customers’ clients.

Blackbaud won dismissal of the plaintiffs’ other common law claims for negligence per se and unjust enrichment, however, narrowing the focus of the consolidated class action complaint.
