Monsanto Says Federal Law Preempts Roundup User’s Cancer Suit

Monsanto Co. urged the full Eleventh Circuit to affirm the dismissal of a man’s suit alleging the company failed to warn about Roundup’s health risks, saying federal pesticide labeling law preempts his claims.

John Carson Sr. alleged he developed soft-tissue cancer from decades of using the glyphosate-based weedkiller on his lawn. His suit was thrown out by a district court and reinstated in July 2022 by a three-judge appeals court panel.

In December 2022, the full US Court of Appeals for the Eleventh Circuit vacated the panel opinion and ordered Monsanto’s appeal to be heard en banc.
