Reynolds Loses Bid to Take Tobacco Flavor Ban to Supreme Court

A Los Angeles ban on sales of menthol cigarettes and other flavored tobacco products survived a legal challenge by R.J. Reynolds Tobacco Co. Monday when the US Supreme Court declined review.

A divided panel of the US Court of Appeals for the Ninth Circuit upheld the ban in March 2022, holding that the federal Family Smoking Prevention and Tobacco Control Act doesn’t preempt it.
