European Commission Loses to Poland Over Energy Tax Breaks

The European Commission has fumbled its case against Poland by focusing on a technicality rather than whether the country’s tax system motivated energy-intensive undertakings to reduce emissions, the EU’s top court ruled Thursday.

The commission argued before the European Court of Justice that an undertaking’s participation in the EU Emissions Trading System wasn’t enough to exempt it from minimum excise duty on the consumption of energy products for heating purposes.
