A former district attorney who helped investigate a missing woman’s case isn’t immune from a malicious prosecution claim by the woman’s husband, who was tried four times for her murder, a federal trial judge said.
Former Tioga County, N.Y., District Attorney Gerald Keene is absolutely immune from Calvin Harris’ suit for any actions tied to his prosecutorial duties. But that immunity doesn’t attach to Harris’s activities in the investigative stage of the case, the opinion by Judge David N. Hurd of the US District Court for the Northern District of New York said Thursday.
