Medical-Supply Monopoly Lawsuit Bounced Over Market Definition

New York-based medical devices firm Endure Industries Inc. lost its appeal in a monopolization lawsuit against Vizient Inc. as the Fifth Circuit affirmed a lower court’s finding that the company failed to define a relevant market, a key issue in antitrust cases.

The district court correctly granted summary judgment to Vizient after finding that Endure failed to establish a legally sufficient definition of the relevant markets for medical products, the US Court of Appeals for the Fifth Circuit said Tuesday.
