Amyris, Board Member Settle With Investor After Trip to 9th Cir.

An Amyris Inc. shareholder has dropped his derivative suit over alleged short-swing trading by a board member’s investment fund because the parties have reached a settlement, according to a court filing.

The voluntary dismissal Tuesday in the US District Court for the Northern District of California leaves unresolved an issue that the US Court of Appeals for the Ninth Circuit sent back to the lower court last year: whether the Amyris board’s exemption for the trades extended to the fund, which wasn’t a director, as well as covering the fund’s indirect owner, who was one.
