Aqua Pennsylvania Wastewater Inc. asked a bankruptcy judge to dismiss a suit by the city of Chester, Pa., seeking to block the transfer of sewer assets from the Delaware County Regional Water Quality Control Authority.
Aqua is seeking declarations confirming its interpretation of a reversion provision in a 1973 agreement, validating the transfer of rights under the asset purchase agreement, and allowing the sewer asset transfer to proceed, according to a March 6 response in the US Bankruptcy Court for the Eastern District of Pennsylvania.
