It’s been over a year since a federal district court imposed sanctions against the New York attorney who carelessly relied on ChatGPT for legal research in the Mata v. Avianca, Inc. case. While most attorneys have heeded the warnings to use generative AI carefully and responsibly, there are still some attorneys who have relied on the technology blindly and been sanctioned for it.
Even more troubling is the use of generative AI by pro se litigants, who use chatbots as free legal advice and don’t have the legal aptitude or tools to distinguish between real and fake cases.
