Case Remanded for Review of Plea, Denial of Motion to Withdraw

A defendant who was denied permission to withdraw his guilty plea to a drug and gun charge is entitled to a new hearing for the district court to more fully articulate its reasoning for the denials, the Sixth Circuit said.

The district court should also re-examine its decision denying a request by attorney Andrew Sanderson to withdraw from representing Demetrius Troutman, the unpublished opinion by Judge Richard Allen Griffin said. “Because the record is insufficient to permit meaningful appellate review, we issue a limited remand for the district court to consider anew its denials of these motions,” Griffin said Thursday. ...
