A federal appeals court will pause consolidated litigation challenging an EPA regulation describing how the agency determines whether chemicals have so much potential to harm people or the environment they must be restricted.
The US Court of Appeals for the District of Columbia Circuit’s order, issued on Wednesday, means the court will not issue a near-term opinion on core and disputed interpretations of Congress’ intent when it directed the Environmental Protection Agency in 2016 to start routinely evaluating potential harms from chemicals and restricting unreasonable risks.
